Effective date: 15/08/2025
1. Who we are
Flotsam Fables (“we”, “us”, “our”) sells original artworks, prints and related products created by Becky via this website.
Website: https://flotsamfables.com
Email: contact@flotsamfables.com
Business address: [Insert address]
Company number (if applicable):
By using this site or placing an order, you agree to these Terms & Conditions.
2. Using our website
You may browse and purchase for lawful purposes only. We may suspend or restrict access for maintenance, updates, or security. Content (including images, text and layout) is provided “as is” and may change without notice.
3. Products & descriptions
We take care to describe items accurately. Because Becky’s work is handmade or produced in small batches, minor variations in colour, texture and size may occur. Screen colours can differ from real-life tones.
4. Prices, currency & taxes
Prices are shown in GBP (£) and include UK VAT where applicable. We may update prices at any time, but confirmed orders are not affected. Orders delivered outside the UK may be subject to local taxes, duties and handling fees, which are your responsibility.
5. Ordering, acceptance & payment
To place an order, add items to your basket and complete checkout. You will be asked to confirm acceptance of these Terms & Conditions. Payment is taken via our WooCommerce checkout using the payment methods shown. A contract is formed only when we email you an Order Confirmation. If we cannot fulfil an order (for example, due to stock or an error), we will cancel and refund you promptly.
6. Delivery
We aim to dispatch within the timeframe indicated on each product page and, unless otherwise agreed, within 30 days of your Order Confirmation. Delivery timescales are estimates and may be affected by carrier delays or customs processing.
Risk & title: Risk in the goods passes to you on delivery. Title passes once we receive full payment.
7. International deliveries
International orders may incur customs duties, import taxes and brokerage fees. These charges (and any delays arising from customs inspections) are outside our control and are your responsibility.
8. Right to cancel (UK consumers)
If you are a UK consumer, you have a statutory right to cancel most online purchases within 14 days of receiving the goods (“cooling-off period”). To cancel, email contact@flotsamfables.com with your order number and a clear statement that you wish to cancel.
You must return the goods within 14 days of telling us you are cancelling. Keep proof of posting. We will refund the product price and the standard delivery cost within 14 days of receiving the goods back (or proof that you sent them), using your original payment method. You are responsible for return postage, except where the item is faulty or misdescribed.
Exclusions: Your right to cancel does not apply to goods that are made to your specifications or clearly personalised (for example, commissions or custom prints) once work has begun. For hygiene and safety reasons, any items that cannot be returned for health protection reasons and were unsealed after delivery are also excluded.
9. Returns, exchanges & how to arrange a return
For non-faulty returns within the cooling-off period, please contact us first at contact@flotsamfables.com. Items must be unused and in the original condition with any tags/packaging where applicable. We recommend tracked and insured postage. If the returned item arrives damaged due to insufficient packaging, we may deduct an appropriate amount from your refund.
10. Faulty, damaged or incorrect items
If your order arrives damaged or faulty, or you receive the wrong item, please email us within 14 days with your order number, a description of the issue and clear photos of the item and packaging. Your statutory rights under the Consumer Rights Act 2015 apply. Where appropriate, we will repair, replace or refund.
11. Commissions & bespoke work
For commissions or personalised items, we will agree the brief, price, timeframe and any deposit in writing before work starts. A deposit (if requested) may be non-refundable once work begins. Because these items are made to your specifications, the statutory cooling-off right does not apply after work has commenced, unless we agree otherwise or the item is faulty.
12. Digital downloads (if offered)
If you purchase a digital product, you acknowledge that the right to cancel is lost once downloading or streaming begins, provided you gave express consent to this during checkout. If you need help with a file, contact us at contact@flotsamfables.com.
13. Intellectual property
All artworks, images, designs and content on this website are the intellectual property of Becky and/or Flotsam Fables. Purchase of an original or print does not transfer copyright. You must not reproduce, distribute, resell, or create derivative works without our prior written permission. Personal, non-commercial display of a purchased physical artwork is permitted.
14. Promotions, gift cards & mistakes
Occasionally we may run promotions or issue discount codes with specific terms (validity dates, exclusions, usage limits). We reserve the right to correct obvious pricing or description errors. If an error materially affects your order, we will contact you to cancel and refund or to give you the option to proceed at the correct price.
15. Limitation of liability
We are responsible for foreseeable loss or damage caused by our breach of these terms or our failure to use reasonable care and skill. We do not exclude or limit liability where it would be unlawful (including liability for death or personal injury caused by negligence, or for fraud). We are not liable for loss that is not foreseeable or for business losses where you purchase as a consumer.
16. Events outside our control
We are not responsible for delays or failure to perform due to events beyond our reasonable control (for example, carrier delays, strikes, extreme weather, supply interruptions, customs inspections). We will do our best to minimise the effects.
17. Privacy & cookies
Your use of the site is also governed by our Privacy Policy and Cookie Policy, which explain how we handle your personal data and cookies.
18. Changes to these terms
We may update these Terms & Conditions from time to time. The version posted on this page at the time of your order will apply to that order.
19. Governing law & jurisdiction
These Terms & Conditions are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
20. Contact me
If you have any questions about these Terms & Conditions or your order, please email contact@flotsamfables.com.
